Replacing ABS with ABS in Michigan

We are remodeling our upstairs bathroom, and found that it is ABS from the waste stack downstairs to the toliet, shower, sink, and where it vents out the roof. We are relocating everything and adding a bathtub, so we need to replace the three way and run new pipe to all the fixtures. No one in town has ABS, and they all indicated that ABS would not meet code. Do we need to replace everything from the cast iron up with PVC? The reason that I have my doubts about ABS not meeting code is that when we remodeled the downstairs in 2007, we had a very picky inspector who definitely saw all the pipes upstairs and didn't say anything then. This is a guy who made us put in 6 support beams and pull a permit to run my own phone and cable. How can I find out if replacing existing ABS with new ABS is OK?

code says, what you are physically working on, must be brought up to code

if their is another pipe in the house you are not working on, it does not have to be changed

that is why he said nothing last time. the upstairs was not in his scope


call your local building department and talk to the plumbing inspector
he may have different rules for the town you need to know about
