Bathtub spout twists but cannot be removed, Moen patent 3419914

I'm trying to remove my bathtub spout it seems to be a Moen patent. I have looked and do not see a set screw. The spout is definitely made of plastic, coated with some Chrome material. I'm trying to remove it to fix a leaking diverter. The spout rotates 360 degrees but does not move out away from the wall like it's unscrewing. I even looked up the Moen patent which is for the diverter. I thought about trying to cut the plastic spout off or heating to melt it off but so far have avoided that, I'm not sure if the pipe that comes out of the wall is made out of copper, cast iron or plastic if plastic than melting is a bad idea. Any help on how to remove it would be greatly appreciated. On the bottom of the spout next to the wall there is a small slot about 2 mm by 5 mm wide it looks like you could put a slotted screwdriver in there and twist it to help push it away from the wall. I really appreciate anyone's comments. Currently I am using CLR to try to clean up the diverter to make it work better and possibly melt any calcification that may be holding it onto the pipe. I looked hard for set screw and do not see one. Thanks again, Don

Turn the spout counterclockwise a 1/4 turn and then see if you and see the set screw. Use a flashlight. If it is
a moen, they are a slip fit spout. Slip it on and tighten the set screw and then turn the spout back clockwise until
straight. Let us know if you find it.
 
Hello I can easily twist this spout upside down and I do not see any set screw there's only a very small slot next to the wall it's only a few millimeters wide too small to get a set screw in. It has a Moen patent number but it's made on a very cheap plastic material it doesn't look like Moen quality it looks like the thing cost about $5 it's really crappy quality
 
It has to come off, right? If it is as cheaply made as you describe you can probably break it apart with some pliers. If it isn't quite that fragile also use a hacksaw to remove a small piece at a time, being careful not to cut the pipe if it extends far from the wall. Once enough of the tip is gone you will be able to see down the interior of the spout, possibly all the way to the wall, at which point it should be obvious what is causing it not to slide off.

Yes I understand it has to come off I just didn't want to break it and make it not usable as it started working now I just wanted to figure out if it was a screw-on or a set screw
 
After seeing your pictures that is not a slip fit spout. Can you get to the back of the faucet?? If so look and see
what pipe type is coming from the elbow.

It just spins both ways. there is no set screw or anything. i want to replace it so would the best thing to do be to just use a grinder and hack away at it?

Got them. Your spout is not a newer moen. First of all do you have access to the back of your faucet.
 
Okay. What would you recommend would be the best way to do that since it just spins? Use snippers or a grinder and just go piece by piece? The guts of the faucet are shot, as when you run the shower more water comes out the tub faucet than the shower. So if it gets destroyed I do not necessary care.

It looks like there is a threaded receiver right near the end of the spout, and that it is made to go over a threaded nipple.

So possibly the guts inside are broken, and that is why it won’t unscrew.

If it is plastic, I would start cutting it up with a hack saw, being careful not to cut into the nipple.
Then break up the body with pliers.
