Default Overflow Drain issue on Deep Soak Tub

I am installing a new tub and have a small problem with the overflow drain, which I hope shows up in the attached photo.

The tub is an American Standard 7236 Deep Soak Tub and to go with it I have the matching Deep Soak Drain (1599.205). The problem I have is that the pitch of the underside of the tub rim does not match the pitch of the rubber gasket, leaving me about 1/4 to 1/2 inch gap. The photo attached shows the gap.

Obviously you hope that the overflow itself is never needed so is it sufficient just to fill this gap with silicone? The only other option I can think of is to actually grind down the underside of the tub to get a more level surface but really do not want to do it. Other than that I guess I'll have to call AS to see if they offer a thicker gasket.

Any thoughts or suggestions?

One added comment. IN the photo it looks as if I were to tighten the screws the gasket would compress in the front and ultimately fill the gap but it will not. The gap is larger than the thickness of the inside edge of the gasket.

best advice i could give would be to contact the manufacturer, sillicone would not suffice as a long term solution, you want the gasket to sit flush.

I can't see the lower portion of the trip waste. But my first thought is the section from the tub shoe to the tee for the overflow is to short. If it was longer it would change the alignment of the overflow to fit the tub better.

To complete the documentation of this problem....

I contacted the Manufacturer (American Standard) today. They have modified the gasket for a better fit and will be sending me a new one to try out. However, to them it sounds like this will still not fix the problem in which case they may need to send someone out to "grind down the underside of the tub more".

Pretty good customer service. We'll see what happens next.

ANother update for future readers

- The new gasket sent to me was the same as the original and had no effect
- I sent photos of the underside of the tub to AS and they confirmed that the fiberglass underside appears to be formed improperly.

AS is contracting a local specialist (company named "Surface Specialists") to come onsite to rework the underside. Sounds as if they expect to actually add fiberglass and reshape as opposed to just grinding down as originally indicated.

The big learning for myself and other novice plumbers -- if things don't look right don't try to just make it work. If it doesn't look right it probably isn't, so contact the manufacturer.

And I don't know other's experiences but the customer service from American Standard is wonderful!

There service is good but I can't say the same for there quality control. They also had a big problem with there toilets sitting flat on the floor.

And with the Cadet toilets not wanting to flush. I don't know how many of those I have changed out.

Yea I lost track they had so many failures, a Cadet,Cadet2 and I think a Cadet3.
